In a significant legal development, two Hawaii-based real estate developers have filed a lawsuit against baseball superstar Shohei Ohtani and his agent, Nez Balelo. The lawsuit arises from allegations that Balelo orchestrated a scheme that led to the developers' dismissal from a high-stakes, $240 million luxury housing project that had been in the works for over a decade. This legal action was initiated in the Hawaii Circuit Court.
The lawsuit claims that Balelo, who is affiliated with the Creative Artists Agency, engaged in a "calculated and unlawful scheme" aimed at undermining the developers' work. Ohtani's involvement as a public-facing sponsor for the project further complicates the matter, especially after he acquired a stunning $17 million home within the luxurious Mauna Kea Resort community.
According to the complaint, Balelo and Ohtani allegedly violated the developers' contractual rights by demanding certain concessions, which eventually resulted in the firing of key project figures, Kevin J. Hayes Sr. and Tomoko Matsumoto. This controversial move has raised eyebrows and sparked discussions about the ethical responsibilities of celebrity endorsements in real estate developments.
A spokesperson for Kingsbarn Realty Capital LLC, the developers' business partner, stated, “The allegations against Shohei Ohtani and Nez Balelo are completely frivolous and without merit.” They emphasized that Kingsbarn takes full responsibility for its decisions regarding the project and looks forward to completing the Mauna Kea project, which is described as "world class." This statement reflects Kingsbarn's commitment to the project despite the ongoing legal disputes.
Josh Schiller, the head of sports and gaming at Boies Schiller Flexner LLP, representing the plaintiffs, revealed that attempts to negotiate a private resolution with Balelo and Ohtani were unsuccessful. He stated that the plaintiffs believe Balelo and Ohtani exploited their celebrity status to disrupt the developers’ involvement in the project, primarily for their financial gain.
According to the lawsuit, Hayes and Matsumoto were originally brought onto the project for Ohtani's promotional value, which was seen as a potential magnet for other high-net-worth buyers. However, the plaintiffs allege that Balelo's interference became a "destructive force," claiming he responded to business discussions with hostility and threatened retaliatory litigation if his demands were not met.
The complaint reveals a timeline that dates back to 2013 when Hayes and Matsumoto conceptualized the project. It also details how they secured Ohtani’s endorsement deal in 2023, which was seen as a pivotal moment for the development. However, the developers claim that by July 17, the situation escalated, leading to Hayes' removal as Managing Member and Matsumoto's dismissal as the listing broker, allegedly at Balelo's behest.
Much of the lawsuit remains redacted, with the plaintiffs seeking to lift these restrictions to disclose crucial information regarding the contractual agreements between the developers and Ohtani. Schiller expressed skepticism about Balelo's threats of counter-suing or claiming contractual breaches, asserting that there is no basis for such claims.
