Kilmar Abrego Garcia is expected to be placed in Immigration and Customs Enforcement (ICE) custody due to an immigration detainer filed by the government. This comes in the wake of a Tennessee judge's order on Sunday that mandated his release from a criminal case. Garcia, a Salvadoran native, was recently returned to the United States from a mega-prison in El Salvador after being mistakenly deported earlier this month.
Garcia faces serious criminal charges for allegedly transporting undocumented migrants within the United States. Federal prosecutors argue that he was involved in a conspiracy that facilitated the domestic transport of thousands of noncitizens from Mexico and Central America, including minors, in exchange for significant sums of money.
During proceedings, U.S. Magistrate Judge Barbara Holmes denied the government's request to detain Garcia. She stated that if released, it is likely he would be detained in ICE custody due to the government’s immigration detainer. In her comprehensive 51-page order, Judge Holmes noted that the government failed to establish a serious risk that Garcia would either flee or obstruct justice related to the case.
Judge Holmes criticized the government's claims that Garcia is affiliated with the notorious gang MS-13. She pointed out that the evidence presented consisted mainly of general statements and double hearsay from cooperating witnesses. Notably, she highlighted that Garcia has no prior criminal history, and the allegations regarding his gang membership contradict the evidence submitted by the government during a hearing two weeks ago.
In her ruling, Judge Holmes emphasized that the circumstances surrounding Garcia's case do not support the notion that he poses a danger to the community or has a strong incentive to flee prosecution. She expressed skepticism regarding the reliability of testimonies from two cooperating witnesses that were crucial to the government's case, stating that their accounts defy common sense.
Judge Holmes also remarked on the potential sentence Garcia faces if convicted, suggesting that it is not severe enough to warrant a serious risk of flight. She referenced historical data, noting that since 2005, the average sentence for human smuggling convictions has been around 12 months. A hearing has been scheduled for Wednesday to assess the conditions of Garcia's release.
In response to Judge Holmes' order, Robert McGuire, the Acting U.S. Attorney for the Middle District of Tennessee, has filed a motion seeking a stay on the release order. Garcia's case has been contentious, especially following his deportation to El Salvador's CECOT mega-prison in March, despite a 2019 court ruling that prohibited his deportation due to fears of persecution. The Trump administration had argued for nearly two months that they were unable to return him to the U.S., where he now faces a two-count indictment.
