This courtesy, typically extended to past presidents, was denied to Trump at that time. Biden’s action then is now being used as the precedent for the current revocation.

Special Counsel Robert Hur submitted a comprehensive report detailing Biden’s improper handling of classified records. The report confirmed frequent memory lapses on Biden's part and contradicted his earlier claims. Furthermore, Hur testified in March, presenting evidence that indicated pride and financial motivations behind Biden's retention of classified documents. Despite these findings, Hur did not recommend criminal charges.
